These Terms of Use (“Terms”) govern your access to and use of Derk (“Derk”, “we”, “us”, or “our”), including our website, dashboard, sandbox environment, and AI-powered chat widget (collectively, the “Service”). By using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
Derk lets you create and configure an AI-powered chat widget for your website, test responses in a sandbox environment, and review and manage conversations through a chats dashboard. Depending on your configuration, the Service can escalate conversations to your team (or an expert) when assistance is required.
You may use the Service only if you can form a binding contract where you live. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information and to keep it up to date.
The Service allows you to provide business knowledge (such as FAQs, policies, and extra information) to help the AI respond. You are responsible for the content you provide and for ensuring it is accurate, appropriate, and lawful.
The Service stores chat messages and conversations between website visitors, the AI, and (when applicable) your team. You are responsible for how you use these features and for any instructions or responses you send through the dashboard.
You can whitelist domains to ensure the widget only works on your website. You are responsible for where you embed the widget and for maintaining control of the sites and domains you authorize.
You agree not to misuse the Service. For example, you will not:
The Service includes AI-generated responses. AI outputs may be incorrect, incomplete, or not appropriate for every situation. You are responsible for deciding whether to rely on AI responses and for configuring escalation to your team when needed.
Derk offers free and paid plans. Plan features, usage limits, and pricing may vary by plan and may change over time. If you subscribe to a paid plan, payments and subscriptions are processed through our payment and merchant-of-record providers (for example, Polar).
The widget is used on third-party websites that you control or manage. You are responsible for your website content, your relationship with your visitors, and any notices or policies you provide to them.
We may suspend or terminate access to the Service if we believe you have violated these Terms or if needed to protect the Service, users, or the public.
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or reliable.
To the maximum extent permitted by law, Derk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
We may update these Terms from time to time. When we do, we will update the “Last updated” date. Your continued use of the Service after changes become effective means you accept the updated Terms.
